Referral Terms

1.1. Friendbuy offers customers ("you") of Henry Rose (“we,” “our,” or "us") the opportunity to refer friends (“Friends”) to try Henry Rose's fragrances or other products ("Products") in its Friendbuy Referral Program (“Program").

1.2. These terms apply to individuals who are accessing or using the Program either as a referrer (“Advocate”) or a friend (“Friend”) referred to the Products.

1.3. By participating in the Program, Advocates and Friends agree to be bound by Henry Rose’s website Terms and Condition, Privacy Policy, and these Terms and Conditions. These Terms apply to your access to, and participation in, the Program. Any changes or modifications will be effective immediately upon posting them to www.henryrose.com.  You agree to waive any right you may have to receive specific notice of such changes or modifications. Your continued participation in the Program confirms your acceptance of these Terms and any such changes or modifications. If you do not agree to these Terms and Conditions, our website Terms of Use, and our Privacy Policy in their entirety, you are not authorized to register as an Advocate or Friend or participate in the Program in any manner.  OUR PRIVACY POLICY AND WEBSITE TERMS OF USE CONTAIN IMPORTANT INFORMATION ABOUT YOUR RIGHTS. Please take the time to read them.

2.1. To participate in the Program as an Advocate, you must provide your email address to Henry Rose and provide a Qualified Referral.  A Qualified Referral is defined as a purchase made at www.henryrose.com by a customer (a "Friend") who arrives to our website by clicking your Refer-a-Friend program link.  You are limited to one Qualified Referral for each referred Friend. Additional/repeat purchases made by a Referred Friend are not counted as additional Qualified Referrals.  The referred Friend and the Advocate cannot be the same person.  For you to earn referral rewards as an Advocate, the referred Friend must complete an order greater than $20 in total value, minus all fees including taxes, discounts, shipping, returns, chargebacks, fraudulent payments, and/or other 3rd party fees.  Eligibility is limited to individuals only.  Henry Rose’s Refer-a-Friend Program cannot be used by businesses for affiliate lead generation as determined in Henry Rose’s sole discretion.

2.2. There are limits in place on how many and how frequently referrals can be made by any single referrer.  Rewards may not be given if those limits are exceeded.  Referral credit cannot be applied to previous purchases, and is not redeemable for cash.

2.3. Rewards must be claimed before the expiration of codes within twelve (12) months of issuance of the reward.  Rewards will be issued with codes that expire after this time.

2.4. Henry Rose reserves the right, at its sole discretion, to prevent any individual from participating in the Program.  Henry Rose reserves the right to refuse the issue of any reward to any Referred Friend or Advocate at any time.  If we do so, you will not be able to obtain further coupons or rewards, but you will be able to use coupons or rewards you have already earned until they expire.

2.5. The Program is subject to modification or termination at any time without notice in our sole discretion.  If Henry Rose modifies the terms of, or terminates, the Program, it will honor coupons or rewards issued prior to the change except in cases subject to refusal under section 2.4.

2.6. By joining the Program, you consent to receive coupons, rewards, and other information about Products, sales, and offers to the email address you provided when you register.  If you no longer want to receive promotional emails from Henry Rose, you can update your email preferences by clicking a link in our emails to unsubscribe.  You will not be able to receive future rewards via email if you unsubscribe, but you may contact Henry Rose at hello@henryrose.com to receive your codes via mail or telephone.

2.7. Your coupons and rewards, and your account under Friendbuy are personal to you and may not be sold, transferred, or assigned to, or shared with, family, friends, or others, or used by you for any commercial purpose. You may have only one (1) Friendbuy account that is personal to you.

 

3.1. Henry Rose will collect, use, and store your Personal Data (as that term is defined in our Privacy Policy) according to our Privacy Policy, available at  https://henryrose.com/pages/privacy-policy.

3.2.  Henry Rose permits Friendbuy to collect your Personal Data, including, but not limited to, your name, email address, IP address, and shipping address through shopping cart integration) in order to successfully manage the Program. By checking the box prompt before submitting your Personal Data to us, you expressly consent to our sharing your Personal Data, as set forth below.

3.3. Friendbuy will collect, process, and store your Personal Data according to its privacy policy, available at https://www.friendbuy.com/privacy/.

3.4. Friendbuy may share your Personal Data with third-party vendors only to carry out the Program. The Program will share your Personal Data only with third-party vendors agreed to by Henry Rose. These third-party vendors will not contact you and are not permitted to pass your Personal Data to any other vendors.

3.5.  If you have a complaint about our privacy practices, we will work with you in an attempt to resolve your complaint under the arbitration procedures described in the Dispute Resolution section of our website’s Terms of Use.  

To initiate an arbitration proceeding, you must send us a notice of your complaint that includes a written statement of your name, address, and contact information, the facts giving rise to your complaint, and the relief you are requesting (the “Dispute Notice”).  The Dispute Notice must be addressed to:  Henry Rose LLC, 10960 Wilshire Blvd., Suite 1100, Los Angeles, CA 90024 and sent to us by certified mail as described in the Dispute Resolution section of the Site’s Terms of Use.  If we do not reach an agreement to resolve your privacy complaint within sixty (60) days after we receive your Dispute Notice, you may commence an arbitration proceeding under the Dispute Resolution section of the Site’s Terms of Use.  

4.1. If you wish to be removed from the Program, you can do so at any time by contacting: hello@henryrose.com.

5.1.  If any provision of these Terms is found invalid, void, or for any reason unenforceable, that provision is severable and does not affect the validity and enforceability of any remaining provisions.
